1. Introduction and Effectiveness of the General Terms and Conditions of Sale

These General Terms and Conditions of Sale (hereinafter "General Terms and Conditions") govern the remote sale of products and services available via the internet on the website www.altamontagnabio.it (hereinafter the "Website"), as well as the related payment and delivery, in compliance with Italian legislation as per Legislative Decree 206/2005 and subsequent amendments and additions (hereinafter the "Consumer Code").

The seller of the products and owner of the Website is Alta Montagna Bio s.s. Azienda Agricola, with its registered office at Località Madonna delle Coste, 2, 02011 Accumoli (RI), tax code/VAT number 01032290577, REA: RI – 0000000, PEC email address altamontagnabio@pec.it (hereinafter referred to as "Alta Montagna Bio s.s.").

The user accessing the Website to make purchases (hereinafter referred to as the "Customer") is required, prior to placing an order, to carefully read these General Terms and Conditions— which constitute a binding agreement—available on the Website and accessible at any time by the Customer via the link included in the order confirmation email, enabling reproduction and storage.

In the event that the individual making purchases on the Website requests an invoice and/or is not considered a "consumer or user" as defined in Article 3, paragraph 1, letter a) of the Consumer Code, the withdrawal provisions of Articles 7 and 8 of these General Terms and Conditions will not apply, nor will other provisions of the Consumer Code that are specifically applicable to "consumers."

Contracts concluded with Alta Montagna Bio s.s. through the Website are governed by these General Terms and Conditions in compliance with Italian law.

The characteristics and prices of the various products for sale on the Website (hereinafter "Product" or "Products") are shown on the relevant Product pages.

To purchase Products, the Customer must complete and submit the order form in electronic format, following the instructions provided on the Website. The Customer must add the Product to the Cart and, after reviewing these General Terms and Conditions and the Privacy Policy and confirming their acceptance, provide the shipping and billing details, select the desired payment method, and confirm the order.

By submitting an order via the Website, which constitutes a contractual offer, the Customer acknowledges and declares that they have read all the information provided during the purchase process and fully accept these General Terms and Conditions of Sale and the Privacy Policy.

The contract between Alta Montagna Bio s.s. and the Customer is considered concluded with the acceptance of the order by Alta Montagna Bio s.s. Such acceptance will be communicated to the Customer via an order confirmation email containing a reference to these General Terms and Conditions, the order number, shipping and billing details, the list of Products ordered with their essential characteristics, the total price—including delivery charges—and the payment method used. The Customer must check the confirmation email, and if any errors are found (billing or shipping address, contact information, etc.), they must contact Customer Service within a predetermined time frame from receiving the email, using the appropriate contact form on the Website’s Customer Service section. This time frame is set at 12 hours. No requests for modifications to the cart contents will be accepted after this time period. Once this deadline has passed, the order will be processed for shipment, and no further changes will be accepted, without prejudice to the Customer’s rights under Article 7.

Upon receiving the order, Alta Montagna Bio s.s. reserves the right to verify the actual availability of the ordered products; if one or more Products are unavailable, Alta Montagna Bio s.s. will proceed with replacing the Product with a similar one. Should the Customer prefer, they may select a different option: in the Cart, they may choose to replace the product with a similar one, remove the missing product from the order, or—if such an option is available—be contacted by Alta Montagna Bio s.s. for alternative suggestions. It is understood that these options are only available for certain Products.

In the case of one or more missing products, Alta Montagna Bio s.s. will not charge for the unavailable items. If payment for the order has already been made via bank transfer, the refund will be processed according to the terms outlined in point 5.3 of these General Terms and Conditions.

In the case of purchasing variable-weight products, the measurements and weights indicated on the Website are approximate. Alta Montagna Bio s.s. strives to match the requested weight as closely as possible, but slight variations may occur, either higher or lower. For details on how the actual amount of the purchase will be charged, refer to point 5.2 of these General Terms and Conditions.

3. Product Information

The information and characteristics of the Products, along with their respective Product codes, are available on the Website. It is understood that the information on the delivered Products may differ from the information provided on the Website due to factors beyond the control of Alta Montagna Bio s.s., so it is always necessary to check the label and the information on the delivered Product.

The visual representation of the Products on the Website, where available, generally corresponds to the photographic image accompanying the Product description. However, it is understood that the Product images are intended solely for presentation purposes and may not perfectly represent the Product's characteristics and quality, differing in terms of graphics, color, and size. In the event of a discrepancy between the image and the written Product description, the written description shall prevail.

Product prices include all taxes and duties. All prices are expressed in Euros.

4. Standard Delivery in Italy:

For all other destinations in Italy, delivery costs are displayed directly at checkout (in Euros, including VAT) before the order is confirmed.

5. Payment and Billing Methods

5.1 Payment Methods

The Customer can pay for the Products and related delivery charges by credit card or PayPal.

To ensure maximum transaction security, Alta Montagna Bio s.s. does not store Customer payment data, and the transaction takes place on secure servers. From the second purchase onwards, registered Customers may—by selecting the appropriate option—proceed with the purchase without re-entering their data. The credit institution uses the SSL protocol to encrypt data transmitted between its server and the Customer's browser.

Once the order is confirmed, the Customer will be redirected to the PayPal website, where they can pay using their PayPal account, a credit card (including prepaid cards), or other methods accepted by PayPal, following its terms and conditions.

5.2 Authorization and Payment Capture

5.2.1 Authorization and Payment Capture for the Sale of Physical Products
For the sale of physical products—if paying by Credit Card or PayPal—when the Customer confirms the order, only a pre-authorization of the amount on the selected payment method will be made. The actual payment will be processed only when the order is finalized, and the final amount will include only the cost of the products actually shipped, minus any price adjustments due to substitutions or missing products, plus delivery costs and any additional services requested by the Customer.

5.2.3 Authorization and Payment Capture for Variable-Weight Physical Products
For orders containing variable-weight products—if paying by Credit Card or PayPal—when the order is placed, authorization will be requested for the exact amount of the purchase.
The final charge amount will be confirmed only when the order is completed and may vary slightly to account for price differences due to weight variations, substitutions with lower-priced products, or missing products. The maximum variation allowed is +10% of the total cart value. Any unused pre-authorized amounts will be released back to the Customer’s account in a short time, following the timeframes established by the selected payment method or bank.

To protect the Customer, in the case of a substitution with a lower-priced product, the lower price will be charged. In the case of a substitution with a higher-priced product, only the cost of the original product chosen by the Customer during purchase will be charged.

5.3 Refunds
In case of a refund, the same payment method used by the Customer for the order will be employed, unless a different method is expressly requested by the Customer. The refund will be processed within 10 business days of Alta Montagna Bio s.s.'s acceptance of the refund. The amount will be credited back to the Customer’s account in a short time, following the timeframes established by the selected payment method or bank.

5.4 Billing of Orders
If the Customer wishes, they may request an invoice by selecting the appropriate box during the order process and providing the necessary billing information, including tax code and/or VAT number, company name (if applicable), and SDI Recipient Code. In this case, the invoice will be automatically sent to the customer’s tax box, in accordance with the law. The customer is responsible for correctly entering the billing details and is expressly informed that, if an invoice is not requested at the time of the order, it cannot be requested later.

6. Shipping and Delivery
The Products purchased on the Website are delivered to the address provided by the Customer during the purchase process in the "Shipping Details" section.
